Texas is one of the last holdouts to decriminalize cannabis or implement a true medical program. Despite this, the citizens of the Lone Star State have been taking matters into their own hands.
Since the adoption of the 2018 Farm Bill, Texas lawmakers passed the framework for legal hemp cultivation, production, and distribution in the Lone Star State.
This has allowed there to be a thriving hemp industry. An industry where alternative cannabinoids such as Delta-8 THC have flourished.

Delta-8-THC & the Rise of Hemp-Derived Cannabinoids
Currently, Delta-8-THC has sparked national debate regarding its legality. This is because it exhibits similar psychotropic effects to Delta-9-THC. However, it is permitted under the 2018 Farm Bill.
Fortunately, this legal loophole has allowed consumers in non-legal states to have access to cannabis products.
Delta 8 THC has been especially important in Texas because their medical program only allows for CBD oil.
Unsurprisingly, Texas’ Department of State Health Services (DSHS) has taken aim at Delta 8 THC products. It declared the cannabinoid a Schedule I controlled substance. However, DSHS failed to alert any CBD stores or manufacturers of this change.
This has been leading to mass confusion among those in the industry.
Nevertheless, this issue will be resolved soon. A judge ruled in favor of a temporary block on the Delta 8 ban. We therefore should see the final verdict in a court hearing this month.
Regardless of the outcome, Texas hemp producers will continue to find legal loopholes.
This is due to the fact that alternative cannabinoids like THC-O, THC-P, and HHC have found their footing in the industry.
